Speech Plus Essay Research Paper Speech plus free essay sample
Speech Plus Essay, Research Paper Speech -plus, the incorporation of pure address and some sort of action, is a freedom that is by and large non protected purely as pure address because actions may jeopardize safety or struggle with the rights of others. Merely as pure address, it incorporates the spoken word. But in add-on to it, the # 8220 ; plus # 8221 ; may take the signifier of marching, vocalizing, intoning mottos, or the awful picketing. The purpose of these actions are for the intent of conveying attending to the address in which they are seeking to acquire across- to affect bystanders, uninterested people, or even the hostile groups. Through the first amendment, the # 8220 ; address # 8221 ; in speech-plus is by and large constitutionally protected. On the other manus, the # 8220 ; plus # 8221 ; may be capable to some ordinances. In add-on, it has become one of the most frequent of all activities. For case, work stoppages by labour brotherhoods frequently include picketing outside shops, mills, or schools. Peoples besides form lookout lines, carry marks, and March in an orderly manner when protesting the policies of another organisation. In two supreme tribunal instances of Thornhill v. Alabama ( 1940 ) , and Milk Wagon Drivers Union v. Meadowmoor Dairies ( 1941 ) , a definite line is shown between what action in speech-plus is protected, and what is condemnable. In the instance of Thornhill v. Alabama, the inquiry of what picketing tolerable was upheld, and the bound of what the fundamental law protected was drawn. In the instance, a legislative act in Alabama, which declares that it is improper for any individual without a merely cause or legal alibi to picket a topographic point of lawful concern for the intent of impeding, interfering with, or wounding such concern by manner of facts refering labour difference, booklet, word of oral cavity, or otherwise was broken. The suppliant, Bryon Thornhill, was arrested while picketing because of a labour difference, and convicted in the circuit tribunal of Alabama for misdemeanor of the province codification for his words, and upon the fact that he had gathered with others in a lookout line for the intent of wounding a company. What neer occurred was any force. There was neer a menace, or any choler. Therefore, the Supreme Court overruled the strong belief and gave peaceable picketing the full protection by the First Amendment. In the instance of and Milk Wagon Drivers Union v. Meadowmoor Dairies, the opposite consequence occurred, as the Supreme Court decided upon a determination straight in contrast as with the 1 in the Thornhill instance. In this instance, the # 8220 ; seller system # 8221 ; for the distribution of milk in Chicago gave rise to challenge. In the system, dairies sold their milk to sellers, which in bend sold it to the retail merchants. The sellers departed from the on the job criterions set out by the brotherhood for its members as dairy employees, and in order to oblige observation of the criterions, the brotherhood took action against the dairies utilizing the # 8220 ; seller system # 8221 ; . The present respondent, Meadowmoor Dairies, brought suit against the brotherhood to halt intervention with the distribution of its merchandises. Unlike the peaceable picketing of the Thornhill instance, in the picketing of the shops managing Meadowmoor merchandises, there were more so 50 cases of window-smashing, and explosive bombs doing hurt to the workss of Meadowmoor. Three trucks of sellers were wrecked and much more Acts of the Apostless of force occurred. Unlike the first instance, the Supreme Court held that the right to picket can be restricted when there is a menace of force. Since so, the tribunal has besides held that picketing may be limited if it conflicts with valid province Torahs.

Significant Events of the Delaware Colony
Significant Events of the Delaware Colony The Delaware colony was founded in 1638 by European colonists from the Netherlands and Sweden. Its history includes occupations by the Dutch, Swedish, British- and the colony of Pennsylvania, which included Delaware until 1703. Fast Facts: Delaware Colony Also Known As: New Netherland, New SwedenNamed After: Then-governor of Virginia, Lord de la WarrFounding Country: Netherlands, SwedenFounding Year: 1638First Known European Landing: Samuel ArgallResidential Native Communities: Lenni Lenape and NanticokeFounders: Peter Minuit and the New Sweden CompanyImportant People: James, Duke of York, William Penn Early Arrivals The first European arrivals in the area occurred in the early 17th century when the Dutch were involved in establishing many trading posts and colonies around the world including in North America. Henry Hudson had been hired by the Dutch to explore the New World in 1609 and he discovered and named the Hudson River. By 1611, the Dutch had established fur trading enterprises with the Native Americans called the Lenni Lenape. In 1614, Fort Nassau, on what is the Hudson River near Gloucester, New Jersey, was the earliest Dutch settlement in the New World. Peter Minuit and the New Sweden Company In 1637, Swedish explorers and stockholders created the New Sweden Company to explore and trade in the New World, under a charter with Swedish king Gustavus Adolphus. Adolphus died in 1632, and his daughter and successor Queen Christina took over the charters administration. Christinas chancellor formed the New Sweden Company in 1637 and hired Peter Minuit. Minuit was a German-born Dutch resident likely of French Huguenot ancestry, who had previously been the governor of New Netherland from 1626 to 1631 and is most well known for the purchase of Manhattan Island. In March of 1638, Minuit and his two ships, Key of Kalmar and the Griffin, landed at the mouth of a river they named Christina, in what is now Wilmington and founded the first permanent colony in Delaware. Annexed to New Netherland While the Dutch and Swedes coexisted for some time, the incursion of the Dutch into New Sweden territory saw its leader, Johan Rising, move against some Dutch settlements. In 1655, Peter Stuyvesant, New Netherlands governor, sent armed ships to New Sweden. The colony surrendered without a fight.à Thus, the area that was once New Sweden then became part of New Netherland.à British Ownership The British and Dutch were direct competitors during the 17th century. England felt they had a claim to the prosperous New Netherland territory due to the explorations by John Cabot made in 1498. In 1660, with the restoration of Charles II to the throne of England, the Dutch feared the British would attack their territory and forged an alliance with the French against the British. In response, Charles IIà gave his brother, James, the Duke of York, New Netherland in March 1664. This annexation of New Netherland required a show of force. James sent a fleet of ships to New Netherland to demand its surrender. Peter Stuyvesant agreed. While the northern part of the New Netherland was named New York, the lower part was leased to William Penn as the lower counties on the Delaware. Penn wanted access to the sea from Pennsylvania. Thus, the territory was part of Pennsylvania until 1703. In addition, Delaware continued to share a governor with Pennsylvania until the Revolutionary War, even though it had its own representative assembly.à Beginning the War of Independence In October 1765, Delaware sent two delegates to a congress of the colonies in New York to deliberate on a joint colonial response to recent British measures, in particular, the Sugar Act of 1764 and the Stamp Act of 1765. The two men were landholder Caesar Rodney and attorney Thomas McKean: the two men and assemblyman George Read would continue to play a role in the movement for independence.à Delaware declared its independence from Great Britain on June 15, 1776, and signed the declaration of independence with its fellow colonies on July 4. Indoor Management Rules Essay Example | Topics and Well Written Essays - 1000 words
Indoor Management Rules - Essay Example In the UK, most commercial transactions are carried out under the statutory exception, which is the doctrine of agency. The agency of doctrine rule is based on the theory that if an agent signs a contract within his jurisdiction as by the principal, then all obligations and rights as acquired by the agent are passed on to the principal whereupon the latter can litigate and or be prosecuted upon, by on the terms as set within the contract. However, certain reservations within this doctrine brought the Turquand rule into existence, which helped in defining contractual alliances with third parties. The significance of Turquand rule was that this provision gave the third party a right to assume (while signing cheques) that the company directors with whom the contract is signed, has been rightfully appointed and they have the right to en-cash the cheque (matters of internal management). Turquand rule thus stated that a third party signing a contract with a company could view only the exte rnal position of the latter without going into issues of indoor management. However, on close analysis it reveals that the rule does not provide any mechanism or route for the third party to bypass ââ¬Ëprivity of contract ruleââ¬â¢ and prosecute the company. ... the derivations that the Turquand rule does not add anything to concept of agency.à In cases of an internal obligation (in a situation where a ââ¬Ëstrangerââ¬â¢ or the third party is aware of the firmââ¬â¢s indoor management) where a given operation is permitted by a special declaration, the Turquand rule consequently becomes inapplicable. Currently the Companies Act 2006 (section 40)4 has now replaced Turquand rule in English law, where the general aim is to restrict the third party from being negatively affected owing to restrictions on authority as set within a companyââ¬â¢s constitution. A closer look at section 40 reveals that the ?eld still remains complicated (the section being inadequately worded leaving scope for misinterpretation). The basic flaw is the wording, where it is seen that in section 40à (1) it is unclear as whether the third person or P is ââ¬Ëa person dealing with a companyââ¬â¢? It is evident that this individual is a ââ¬Ëperson,â⬠⢠but it remains unclear whether he is ââ¬Ëdealing with a company.ââ¬â¢ There is delineation to this effect in section 40 (2), where it states that a person clearly ââ¬Ëdeals withââ¬â¢ a firm when he is part of any transaction or any other activity,à where the firm ââ¬Ëis a partyââ¬â¢. Again the wording here is unclear, as the term ââ¬Ëpartyââ¬â¢ is liable to be construed as a situation where the firm has signed a legal deal with the person. Here the primary difficulty is from the perspective of the person or individual (with whom the firm signs the deal). Unless the person can present as evidence that this section or another oneà is applicable that can remove the corollary of ââ¬Ëconstructive notice doctrine,ââ¬â¢ it will be impossible with facts at hand to prove that the firm is a ââ¬Ëpartyââ¬â¢ and hence can be prosecuted. Thus, the basic

Why military leaders need Critical and Creative Thinking to be Essay
Why military leaders need Critical and Creative Thinking to be successful - Essay Example Todays military leaders are constantly compelled to act as "out of the box" thinkers. Such statements give the impression that the only comprehensive solutions are those that have never been conceived. However, what a professional military education system (PMES) as well as the military really endeavor to produce are leaders that have strongly critical as well as creative thinking skills (Hbr 1). Both indirectly avoid the idea that the box even exists. Todays organizations function in what the U.S War College describes as a VUCA setting. Volatility, complexity, uncertainty, and ambiguity are continuous realities within the 21st century. The military tries to prepare for challenges it could probably face by creating realistic training scenarios as well as routinely adding such activities into its ongoing operations. The objective is not to teach them what to think, but to develop their ability to think creatively and critically about the number of contingencies posed by a dynamic environmentââ¬âin essence to educate them how to think appropriately. The expression "professional military education"(PME) shows the duality of the system. It is intended to both increase the militaryââ¬â¢s professionalism as well as educate it. These are related as well as overlapping goals, but they are not similar. Professionalism means that the military leaders share both an amount of knowledge directly associated with their mission and ethics. While education implies a widening beyond the limitations of knowledge directly associated with the mission and the advancement of critical and creative thinking. Good decision making is one of the traits together with good leadership that is significant when it comes to command. Critical and creative thinking also has significant consequences for group dynamic skills as well as quality control. Critical and creative

6. ââ¬ÅIt Is More Important to Discover New Ways of Thinking Essay
Developing new ways of thinking about what we already know is very important as it helps us to develop a better understanding of that which we already know so to some extent the above statement is true. However it is as significant to discover new data or facts. In fact these two concepts go hand in hand; it is because of some discoveries that we knew when they first came to light that we have something we call existing knowledge to think about and sometimes it is through trying to develop new ways of thinking about a certain issue without a solution that we finally decide it is best to find a new explanation or concept of looking at it. A student who goes from lower to higher school both learns new and advanced ways of thinking about the information they have gathered in previous grades as well as some new data they have never come across before which further stresses that both concepts are important. We cannot learn everything at once nor can we know all sbout those things we know, which is why both developing what we already know and leaarning some new things are equally important. In some cases one may find that discussing and thinking about what we already know but in a new clearer way can help us reach a conclusion whereas if we had chosen to discover new facts about it instead, our horizon of confusion would have been broadened and we find ourselves with yet another mystery to solve. A good example of a case like this is death. Unless someone dies and comes back and tells us exactly what happens after death, no one can ever really know what happens. Any information we all have of life after death is based on assumptions that is if there is even life after death. Discovering new facts about the so called life after death isnââ¬â¢t but going to cause even more confusion, so really in my view I would say it is rather best that one sticks to the knowledge and believe they have over this issue, and if anything, find new ways of thinking about instead of creating yet another confusing phenomena based on assumptions. But such fields as Science motivate constant discovery of new knowledge because this is one area of knowledge where falsification is the only method used to prove the theories because we cannot verify, in other words prove a Scientific theory to be true in any way but we can pfove it fo be wrong. In this case it is clear then that in Science it is more important to discover new facts or data than to think about that which we already have as we need new discoveries to falsify old theories. However sometimes it may be thinking hard and deep into a scientific theory that makes one see fault in it as a result make new discoveries in which case both thinking of something in a new way and making new discoveries would have been equally important. We can for instance look into the famous example of the falsification of Newtonââ¬â¢s theory of gravitation by Einsteinââ¬â¢s theory of relativity. Einstein like all other Scientists of that time saw nothing wrong with Newtonââ¬â¢s model until a crisis came when Newtonââ¬â¢s theory of gravity failed to account for the behavior of light. Obviously this had to be a result of scientists thinking of new ways of applying Newtonââ¬â¢s model. No one expected the negative outcome they came out with but it was negative and the Scientists were faced with a dilemma they had to solve. That it is when Einstein invented his theory of relativity, a whole new theory, which could work even for those discoveries that Newtonââ¬â¢s model failed to. In any case, the point is to show that finding new ways to think of something can actually lead to the discovery of new information which in turn gives us something new to think about and in new ways if we please. Living only by developing things we already know would be depriving ourselves off so much knowledge. Had the people who lived before our generation decided they wanted to live only on what they knew, there would be so much we do not know. Generations like that of Newton or Einstein, generations like that of Priestley or Lavoisier who made discoveries about oxygen and those of people who learned the word of God and passed it on from generation to generation till the bible was written we would not have the knowledge we have today. And the knowledge does not end there and like the paradigm shifts suggest, there will always be new information, new theories and new ways of thinking as the world revolves that will override the current theories but should we decide to live only by the data that already exists, we may find that we are making experiments with 90% errors all the time.

Role of Literature in the Age of Technology
Literature refers to the realm of letters and the writings of a particular period, mostly those whose value lies in the beauty of form or emotional effect. Technology is the science of the industrial arts. Scientists have played an important role in promoting human welfare, but the benefits of science may not have reached the masses, at any rate in ample measure, without technological devices and practical applications. We live in the world of both science and technology and many people, who take a rather superficial view of things, have begun to feel that in the technological world of tomorrow the role of literature seems poor.In fact, literature in its pure form is believed to have little relation with science and technology. Science provides knowledge and power and both science and technology affect human life at several points, though the extent and utility of the applications are determined by our culture, our wisdom and our priorities. Literature reflects the moods and emotions of the times in which it is produced; it is conditioned by the reflexes which, in turn, are created by the impact of science and technology.Modern technology increasingly dominates the world, and the domination is likely to become more pronounced in future, because of the fast developments tending to subdue creative human thinking and expression. But the belief that literature would have no place in future and in futuristic calculations is erroneous. There is no reason to believe that the mechanical way of life, in which our actions are governed more and more by computer culture and electronic calculators of all types, will destroy the talent of writers, authors, poets, biographers and artists.Technology does not discourage natural, multi faceted talent; rather, it generally promotes the climate for expressions of talent in countless channels. All round prosperity helps a great deal in creating literature of lasting value, and it is technology which has made many countries wealthy and prosperous. Jawaharlal Nehru cautioned us some four decades ago that it was only through the growth of technology that our country would become prosperous. In some cases technological development and automation may cause misery, through the resultant unemployment, for instance. But it has to be noted that both science and technology also provide additional avenues for employment; countries which boast of maximum employment, or nearly so, are those which are technologically advanced. In fact, our country may go down, instead of progressing fast, if we do not keep pace with technological developments and march in step, as far as possible, with the industrialised and technologically progressive nations. It is not only for the sake of the material benefits, the comforts and conveniences of life that we must opt for the latest technological processes, even by discarding our traditional practices, but for our art and literature, too, we shall have to make the best of technology, which w ould enable talented people to put in their best in art and literature. Some people think and they have a reason for doing so, that since science demolishes faith and tradition, it tends to produce scepticism, anxiety and even tensions, and it doubts everything, even cherished values.Science has eliminated superstitions. Technology helps to provide weapons of war; war stimulates technologists, but it depresses the artists and those who prepare literary pieces. Sensitivity and the urge to create new masterpieces get suppressed; reckless destruction, bloodshed and hostilities ruin the very climate that helps to create literature and artistic masterpieces. Culture and literature, after all, indicate the cultivation of man's inner nature.Culture prompts men and women to seek perfection; they are not motivated by curiosity and the endless sense of enquiry which characterise scientists and technologists. Literature expresses feelings and innermost thoughts and ambitions, while technology has other ends and other fields to explore. Literature may at first appear to be out of place in a technological milieu, but surely scientists and technologists do not encroach upon the field of literature. There seems to be no reason why both literature and technology cannot flourish side by side.A society that is highly progressive technologically may also become rich in literature. We may take the example of the world's most industrially advanced country and the mightiest military power, the USA, where technology has registered unprecedented achievements and yet the USA has produced rich literature. Technology results in affluence and prosperity and economic prosperity promotes good literature and masterpieces in the arts. So there is no contraction involved. It is only during war and the all out preparations for war, that literature gets a setback.Science and technology, it has been truly said, have radically altered the face of civilisation, but nothing, not even the most sophi sticated mechanical devices and the most fruitful applications of new inventions, can change human nature or replace human being, who must indeed remain in effective command of all scientific inventions and their day-to-day application. Technology has created robots, artificial intelligence in the shape of ââ¬Å"thinking computersâ⬠which can read, translate, interpret and give decisions with amazing speed and accuracy. But not even the most sophisticated technological advances can by themselves produce literatureââ¬âpoetry, prose, plays, novels and stories. In a sense, science and technology may be said to be of direct assistance in promoting literature, because they help to create leisure by introducing labour saving and time saving devices and by eliminating drudgery as well as duplication of effort. The leisure thus created can be put to literary pursuits. In such a context, the talk of a contradiction between technology and literature is not well founded.Scientific kno w how may thus be viewed as technology which, examined dispassionately, has an important bearing on arts and literature. Good literature makes a lasting impact on the human mind; it entertains, instructs and ennobles the spirit of human beings; it does not debase or corrupt the mind in any way, and it certainly does not lead to destruction of any section of mankind. Science and its handmaid, technology, however, have placed in the hands of man vicious and highly destructive tools in the shape of lethal weapons the like of which he has never had before.Literature builds, but technology, if misused by vicious statesmen and politicians may cause havoc on a massive scale, destroying both litterateurs and technologists without discrimination. Technology does make for concentration and centralisation of economic and political activity. A person's individuality, sense of fraternity and selflessness tend to get eroded. Where there is less patronage of art and talent, there is bound to be le ss of literature of permanent value, because the right spirit and mood are not there to promote it.The depersonalisation of modern life which, it appears, will get stronger as the years pass, is likely to discourage writers and poets; misery, anguish and a generally noisy atmosphere are hardly conducive to the production of sound literature. But we need not give up all hope of a better world tomorrow, from the standpoint of culture and literature, simply because science and technology tend to predominate over human values. It is within the power and capacity of man, provided he exercises his sound judgment and pursues the right priorities to shape a better world, where literature flourishes along with industry and technology.

Conditioning essays
Conditioning essays Conditioning and Its Effects For my paper I wanted to examine the idea of conditioning and focus mainly on the emotional aspect of it. Continuing affects us in several ways. Most the time, in ways we are not fully aware of. One of the more indirect ways is emotionally. I have a close friend, who well call Jordan for reasons of privacy, who seems to be deathly afraid of medicine. While I find this fear irrational and unrealistic, he finds it extremely real and sometimes Until recently I saw no real problem with his fear, but a strange thing happened and I found myself trying to analyze and almost diagnose what had happened. Due to some sort of food poisoning, he was forced to be taken into the local emergency room. His reaction to the food he had eaten seemed to be serious and upon arrival, the first thing the nurse did was place an IV in his arm. Immediately his fear of medicine came into play. Though the IV was different than the medicine he was normally afraid of, the IV fell into a category I believe to be a stimulus generalization. A stimulus generalization is defined as the occurrence of a learned response not only to the original stimulus, but to the other similar stimuli as well. His conditioned response to antibiotics in the past, became a conditioned reaction to all forms of medicine. Jordan acted out the way anyone would to such a fear. He began screaming at the nurse, and tearing at the needle in his arm. After later recalling the incident, he told me that it bothered him even more than taking a pill that they were putting things directly into his blood stream. I was interested by the whole incident and became determined to find the psychological reasons behind his response. As you read this, bare in mind that I am not a psychologist nor a scientist, so if I am far off in my conclusions, forgive me. I began by analyzing Jordans...

A Competitive And Strategic Corporate Analysis Marketing Essay
A Competitive And Strategic Corporate Analysis Marketing Essay Introduction The airline industry is one of the most difficult business sectors where competition has proven to be extremely difficult among the many different competing airline services available around the world. Many airline services in the past have experienced disastrous business cycle, timeliness and overcapacity issues. Moreover, the different airline services also complain of their experienced difficulty in differentiating themselves from competition. These airline services also maintain such high-risk profiles because of such high expectations from their customers (Wirt, Heracleous & Pangarkar, 2007). Singapore Airlines, one of the strongest and famous airline service providers, remains to be one of the most profitable airline companies in the world today. Several reasons can be attributed to the huge success that Singapore Airlines enjoys today. One is its strong brand management strategies driven mainly by its excellent line-up of top-management and boardroom employees. S ingapore Airlines is composed of many dedicated and professional employees both in its front and back-end office who serve as the drivers of its solid brand strategy (Roll, M. 2010). Singapore Airlines is truly a global and diversified organization unified by one aim of delivering excellent quality and service to its customers. What separates this airline from other airline service companies is its heavy investment in building and maintaining its solid brand equity. The Singapore Airlines brand is known for its consistency in delivering its primary message to its consumers which is ââ¬Å"Singapore Airlines- A great way to flyâ⬠coupled with its dedicated and honest delivery of that communication message to its consumers (Roll, M. 2010). The brand strategy of the Singapore Airlines is centered on its world-class in-flight experience: the warmth and hospitality of the Singapore Girl, its excellent service and its focus on the customer. Whereas other competing airline services al so tried to pursue the path that Singapore Airlines has taken, no other airline has matched Singapore Airlines in terms of its honest commitment and consistency in delivering its brand promise to its consumers (Roll, M. 2010). As a result, the Singapore Airlines brand managed to deliver excellent financial results through its three-fold strategy: a.) Avoiding knee-jerk reactionary behaviors on any price changes and consistently deliver the brand benefits in order to maintain a high revenue b.) Cut down the costs by pursuing ownership of the best yet most cost-efficient aircrafts and properly responding to increases in fuel prices and c.) Remaining true to the brand in terms of consistency in delivering service to drive up profits (Roll, M. 2010). Background This report-based paper on the ââ¬Å"Competitive and Strategic Corporate Analysis of the Singapore Airlinesâ⬠aims to evaluate the Singapore Airlineââ¬â¢s actual application of the various analytical and planning tools i n Strategic Management. This paper will also discuss the overall strategic posture of Singapore Airlines at the corporate level, that is, whether it is pursuing a global strategy, multi-domestic strategy, international strategy or transnational strategy. Also, this paper will also evaluate whether the companyââ¬â¢s management structure and philosophy is aligned with its overall strategic posture. Finally, this paper will come up with a list of recommendations with regard to the companyââ¬â¢s strategic focus. Several recommendations will be presented in order for the company to improve and maintain its competitive position.

WWII, Holocaust, Cold War, and Postmodernism - Coursework Example The paper "WWII, Holocaust, Cold War, and Postmodernism" analyzes the holocaust, the cold war, and world war II and their connection with postmodernism. The United States did not get on board with World War II unless it absolutely had to fight back against one of the Axis Powers, which was Japan. During the Holocaust, this atrocity might not have occurred if more people would have defended the rights of human beings to live and coexist peacefully with people from other religious backgrounds, faith traditions, ethnicities, and ability levels. There were numerous people that were murdered due to the fact that the Germans considered them ââ¬Å"undesirable.â⬠The groups included in the undesirable category cut through a wide swath of people, not just limited to the Jewish peopleââ¬âbut also extended to the Gypsies (also known as the Roma or Romani), disabled individuals, individuals with birth defects, homosexuals, Communists, artists, poets, musicians, writers, and anyone else who was considered ââ¬Å"subhuman.â⬠It is very common knowledge that the Germans were ruthless in their treatment of the concentration camp prisoners, for the most part. Elie Wiesel, in his book Night, describes how the blue smoke of the children rose up from the crematories. He describes how he will never forget that night, not as long as he lived, and basically until the death of God himself he promised never to forget. In a way, his writing symbolized a kind of spiritual death as one sees his hopes and dreams turned to dust.
